1. Introduction to these Terms and Conditions

These Terms and Conditions (the "Terms") outline the rules and conditions that apply to your use of the Ember & Odds website located at emberandodds.com (the "Site") and your experience at our restaurant, Card Lounge, Card Room and Offline Poker areas (collectively, the "Venue").

By providing clear expectations for both online and in-venue conduct, these Terms are designed to support a safe, respectful and enjoyable environment where guests can savour premium dining while taking part in friendly, social Offline Poker and card experiences using symbolic poker chips.

If you do not agree with any part of these Terms, you should refrain from using the Site and from visiting or engaging with our Venue offerings.

2. Acceptance of Terms

By accessing, browsing or using the Site, you confirm that you have read, understood and agree to be bound by these Terms, along with any additional policies referenced here, including our Privacy Policy, Cookie Policy and Responsible Play statement.

By entering or visiting our Venue, making a reservation, participating in Offline Poker sessions, joining Poker Nights or Private Poker Tables, you also agree to comply with these Terms and all house rules communicated by Ember & Odds staff, signage or official materials.

If you are making a reservation or booking on behalf of a group, you are responsible for ensuring that all guests in your party are aware of and comply with these Terms.

3. Service Definitions

For the purposes of these Terms, the following definitions apply:

• Offline Poker: Structured or casual poker-style card sessions held in our Venue, played face-to-face at physical tables, using symbolic poker chips for social engagement and entertainment only.
• Card Lounge: The relaxed lounge environment within Ember & Odds dedicated to social card gatherings, including Offline Poker, Texas Hold'em-style games and other friendly card formats using symbolic poker chips.
• Card Room: The focused area of the Venue where Poker Tables are arranged for organised Offline Poker sessions, Texas Hold'em Nights, Weekly Poker Sessions and private card experiences.
• Poker Tables: Specially designed card tables provided by Ember & Odds for Offline Poker and social card activities, intended exclusively for entertainment with symbolic poker chips.
• Texas Hold'em: A popular style of poker-inspired card game offered at Ember & Odds as part of our social Offline Poker and Weekly Poker Sessions, always using symbolic poker chips and strictly for recreational enjoyment.
• Symbolic Poker Chips: Non-monetary chips or markers used at our Poker Tables solely to keep track of play within a game. Symbolic poker chips have no cash value, cannot be exchanged for money, goods or services, and do not represent real-money stakes or prizes.

All Offline Poker, Card Lounge, Card Room, Poker Tables, Texas Hold'em Nights and related Social Poker experiences at Ember & Odds are exclusively for recreational, community-focused entertainment. They must never be treated as opportunities for gambling, betting, real-money play, or winnings of any kind.

4. Use of the Venue

Ember & Odds is committed to providing a premium, welcoming environment that blends high-quality dining with a refined, social card experience. To preserve this atmosphere, guests using the restaurant, Card Lounge, Card Room and Poker Tables must adhere to the following expectations:

4.1 Respectful conduct

Guests must behave respectfully toward all patrons and staff. This includes maintaining appropriate language, attire and demeanour, refraining from disruptive behaviour and following lawful, courteous conduct at all times.

4.2 House rules and staff directions

Guests agree to follow all house rules communicated verbally by staff or displayed on signage relating to dining, seating, Offline Poker sessions, Social Poker, Texas Hold'em Nights and Weekly Poker Events. Ember & Odds staff may, at their discretion, modify seating, relocate guests, adjust table allocations or pause play to maintain comfort, safety and fairness.

4.3 Social, symbolic-chip play only

All card activities in the Card Lounge and Card Room, including Offline Poker, Texas Hold'em, Social Poker and Weekly Poker Sessions, must remain strictly social and entertainment-based using symbolic poker chips. Guests must not introduce real-money stakes, side arrangements or any form of betting to their games.

4.4 Responsible enjoyment

Guests are expected to participate in card activities and social evenings in a balanced and considerate way. Ember & Odds may limit the duration of play, adjust table settings or ask guests to take breaks where necessary to uphold a positive and healthy environment, consistent with our Responsible Play approach.

4.5 Refusal of service and access

Ember & Odds reserves the right, at its sole discretion and in accordance with applicable laws, to refuse service, deny entry or request that a guest leave the Venue where behaviour is inappropriate, unsafe, disruptive or inconsistent with these Terms, our house rules or Responsible Play principles.

5. Booking and Reservations

Ember & Odds offers reservations for both restaurant dining and Poker Tables within the Card Lounge and Card Room. By making a reservation via the Site, by phone or in person, you acknowledge and agree to the following:

5.1 Reservation requests

All bookings, including for Private Poker Tables, Texas Hold'em Nights and Corporate Poker Evenings, are subject to availability and confirmation by Ember & Odds. Submitting a request does not guarantee acceptance until you receive a confirmation notice from us.

5.2 Accuracy of information

You are responsible for providing accurate and complete information when making a booking, including your contact details, preferred date and time, party size and any specific needs related to dining or Offline Poker arrangements.

5.3 Changes and cancellations

If you need to change or cancel a reservation, you should contact us as early as possible using the details on our Contact Us page. While we aim to accommodate reasonable changes, adjustments are subject to availability and any applicable venue policies that may be communicated at the time of booking.

5.4 Group and private events

For larger parties, Private Events, Corporate Poker Evenings or Exclusive Poker Nights, additional terms, conditions or written agreements may apply. These will be communicated to you during the enquiry or booking process for Events and private hire.

5.5 No transfer of symbolic poker chips

Symbolic poker chips issued for Offline Poker sessions must remain within the Venue and may only be used as part of the designated card experiences. They cannot be transferred between bookings, redeemed for value or retained as any form of credit.

6. Privacy Policy Reference

Your privacy is important to us. Our Privacy Policy explains how Ember & Odds collects, uses, discloses and protects personal information in connection with the Site and our Venue.

By using the Site, making a booking, or interacting with us online or in person, you acknowledge that you have read and understood our Privacy Policy and consent to the handling of your personal information in accordance with that policy and applicable Australian privacy laws.

• Encouraging guests to take regular breaks, enjoy their meals and drinks mindfully, and treat card activities as a shared social pastime.

8. Liability and Disclaimer

8.1 Website use

To the fullest extent permitted by law, we do not guarantee that the Site will be uninterrupted, error-free or free from harmful components.

8.2 In-venue experiences

Guests attend and participate in dining experiences, Offline Poker sessions, Social Poker events, Texas Hold'em Nights, Private Poker Tables and other Venue activities at their own risk. To the extent allowed under applicable law, Ember & Odds is not liable for any indirect, incidental or consequential loss, damage or inconvenience arising out of:

• Use of, or inability to use, the Site;
• Changes to reservations or seating allocations;
• Adjustments to or cancellation of Weekly Poker Events, Corporate Poker Evenings or private bookings;
• Personal property loss or damage within the Venue, unless caused directly by our negligence;
• Any misunderstanding or misuse of symbolic poker chips, which have no monetary value.

8.3 Australian consumer law

Nothing in these Terms is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, it is limited to the minimum extent required by law.

Ember & Odds may update, revise or replace these Terms from time to time to reflect changes in our operations, Venue offerings, legal requirements or policies.
